2.       LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA

2.1.      The legal basis for the processing of your personal data is the fact that this processing is necessary for:

2.1.1.   for the performance of the contract between you and the controller or for the performance of the measures by the controller before the conclusion of such a contract within the meaning of Article 6(1)(b) of Regulation (EC) No 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the ‘Regulation’);

2.1.2.   for the fulfillment of the legal obligations, in particular the fulfillment of the obligations imposed on the responsible party by generally binding legal provisions, in particular by law on value added tax in the respectively valid version, by law on income tax in the respectively valid version, and by law on accounting in the respectively valid version.

3.       PURPOSE OF PROCESSING PERSONAL DATA

3.1.      The purpose of processing your personal data is the performance of the contract between you and the controller, including the delivery of goods and the resolution of the rights to liability for defective products, or the execution of the actions by the controller before concluding such a contract and continuing the fulfillment of the associated public law obligations by the controller.

3.2.      For the purposes of Article 22 of the Regulation, no automatic, individual decision-making is made by the responsible party.

4th       PERIOD OF RETENTION OF PERSONAL DATA

4.1.      Your personal data will be processed for the duration of the impact of the rights and obligations arising from the contract and for the duration necessary for the archiving in accordance with the relevant generally binding legislation, but at the latest for the duration determined by generally binding legislation.

5th       OTHER RECIPIENTS OF PERSONAL DATA

5.1.      Other recipients of your personal data are shipping companies and other persons who participate in the delivery of goods or payment processing on the basis of the purchase agreement, and persons who provide technical services for the controller in connection with the operation of the online shop, including the operation of software and data storage.

5.2.      Recipients of your personal data which are processed for the purpose of fulfilling obligations arising from the legal provisions may continue to include the financial authorities or other competent authorities in cases where the generally binding legal provisions require the controller to do so.

5.3.      The controller does not intend to transfer your personal data to a third country (a non-EU country) or to an international organization.

6th       RIGHTS CONCERNED

6.1.      In accordance with the conditions set out in the Regulation, you have the right to request from the controller access to your personal data, the right to correct or delete your personal data or to restrict their processing, the right to object to the processing of your personal data and the right to the transferability of your personal data.

6.2.      If you consider that the processing of your personal data has been violated or the regulation is violated, you have the right to file a complaint with the supervisory authority.

6.3.      You are not obliged to provide personal data. The provision of your personal data is a necessary condition for the conclusion and fulfillment of the contract and without the indication of your personal data it is not possible to conclude the contract or fulfill it by responsible persons.
